EQUINE LAW

Equine law covers a wide range of issues relating to the horse world, and its legislation is scattered throughout various legal and regulatory provisions (rural code, civil code, sports code, public health code, gallop racing code, veterinary code of ethics, criminal code, general tax code, etc.).

Whether you are an owner, rider, riding school, vet, farrier, osteopath, dentist, breeder or company owning equidae, SELARL Benoît LEGRU can help you manage contracts and disputes relating to equidae.

Our passion and knowledge of equine and rural practices are major assets in our dealings with our clients, and contribute to greater efficiency in the handling of cases.

CONTRACT DRAFTING

As part of our consultancy services, we can draw up a range of contracts to help you secure your relationship:

  • Boarding contracts (owner, stable manager)

  • Au pair contracts with an equestrian centre

  • Sales contracts

  • Loan for use

  • Rental contracts

  • Dressage and training contracts

  • Service contracts

  • Transport contracts

THE CONTRACT OF SALE - CONFORMITY - HIDDEN DEFECTS

Contracts for the sale of equidae are the source of numerous disputes arising from poorly drafted contracts and the development of litigation in the equestrian world. The contract of sale requires compliance with the obligations of conformity, delivery of the animal, warranty against hidden defects and delivery of the horse's papers.

We can help you upstream by drafting secure contracts that comply with these obligations.

We can also help you with disputes between buyer and seller, particularly in relation to hidden defects, defects in consent or the guarantee of conformity.

DISPUTES AND LIABILITY

Article 1243 of the French Civil Code states that "The owner of an animal, or the person who uses it while it is in his care, is liable for any damage caused by the animal, whether the animal was in his care or whether it was lost or escaped".

Being the horse's guardian gives rise to numerous disputes.

This is why we can help you if you are held liable for compensation for damage caused to or suffered by your horse as a result of an accident:

  • Accidents in competition (sport and racing)

  • Accidents during outdoor walks

  • Liability of riding contractors

  • Liability of equine vets

  • Farrier's liability

  • Transporters' liability

  • Teachers' liability

  • Hirers' liability

  • Riders' liability

  • Owner's liability

  • Legal expertise

EMPLOYMENT LAW

We act in relations between employers and employees, from recruitment to termination of employment, and in disputes arising from the performance of employment contracts, particularly for equestrian centre staff (trainers, instructors, grooms).

Before the various courts (civil, commercial, criminal and labour), our legal expertise and knowledge of the equine industry enable us to explain equine issues and their specific features to judges, who are often new to this vast field.
